1. Introduction

Welcome to Crazy Toes! These Terms and Conditions ("Terms") govern your access to and use of the Crazy Toes website, mobile application, and related e-commerce services (collectively, the "Platform"). By accessing or placing an order on our Platform, you agree to be bound by these Terms.

Crazy Toes is an e-commerce brand registered in India. These Terms constitute a legally binding agreement between you ("Customer" or "User") and Crazy Toes ("we," "us," or "our").

 

 

2. Eligibility

To use the Crazy Toes Platform, you must:

       Be at least 18 years of age, or have the consent of a parent or legal guardian.

       Be a resident of India or a country where our services are made available.

       Have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.

       Not be barred from receiving services under applicable Indian law.

 

 

3. Account Registration

To place an order, you may be required to create an account on our Platform. You agree to:

       Provide accurate, current, and complete information during registration.

       Maintain the confidentiality of your login credentials.

       Notify us immediately at admin@crazytoes.in if you suspect any unauthorized use of your account.

       Accept responsibility for all activity that occurs under your account.

 

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

 

 

4. Products & Orders

4.1 Product Listings: All product descriptions, images, and prices on the Platform are for informational purposes and are subject to change without prior notice.

 

4.2 Order Acceptance: Placing an order constitutes an offer to purchase. Crazy Toes reserves the right to accept or reject any order. A confirmed order constitutes a binding contract.

 

4.3 Availability: Products are subject to availability. In the event of a stock shortage after your order is placed, we will notify you and offer a refund or substitute product.

 

 

5. Pricing & Payments

All prices listed on the Platform are in Indian Rupees (INR) and are inclusive of applicable taxes (GST) unless stated otherwise.

 

We accept the following payment methods:

       Credit/Debit Cards (Visa, Mastercard, RuPay)

       UPI (Google Pay, PhonePe, Paytm, BHIM)

       Net Banking

       EMI (on eligible orders)

       Cash on Delivery (COD) – available at select pin codes

 

We use industry-standard SSL encryption to protect your payment information. Crazy Toes does not store your card details.

 

 

6. Shipping & Delivery

6.1 We ship across India to serviceable pin codes. Delivery timelines are estimates and may vary based on location and logistics.

 

6.2 Crazy Toes is not liable for delays caused by natural disasters, courier disruptions, government actions, or any force majeure event.

 

6.3 Risk of loss and title for products pass to you upon delivery to the shipping address provided.

 

7. Intellectual Property

All content on the Crazy Toes Platform, including but not limited to logos, brand name, product images, descriptions, graphics, and software, is the exclusive property of Crazy Toes and is protected under applicable Indian intellectual property laws.

 

You may not reproduce, distribute, modify, or use our content for commercial purposes without our prior written consent.

 

 

8. Privacy Policy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Platform, you consent to the collection and use of your personal data as described in our Privacy Policy, in compliance with:

       The Information Technology Act, 2000

       The IT (Amendment) Act, 2008

       The Digital Personal Data Protection Act, 2023 (DPDPA)

 

 

9. Prohibited Conduct

Users are strictly prohibited from:

       Using the Platform for any unlawful, fraudulent, or unauthorized purpose.

       Attempting to hack, reverse-engineer, or interfere with the Platform's functionality.

       Submitting false reviews, misleading information, or impersonating any person or entity.

       Using bots, scrapers, or automated tools to access or collect data from the Platform.

       Engaging in any activity that violates the IT Act, 2000 or any other applicable law.

 

 

10. Limitation of Liability

To the maximum extent permitted under applicable Indian law, Crazy Toes shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising from your use of or inability to use the Platform.

 

Our total liability in any matter arising in connection with these Terms shall not exceed the amount paid by you for the specific product or service giving rise to the claim.

 

 

11. Disclaimer of Warranties

The Platform and its content are provided on an "as is" and "as available" basis. Crazy Toes makes no representations or warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement, except as required by applicable Indian consumer protection law.

 

 

12. Governing Law & Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws of India, including but not limited to:

       The Indian Contract Act, 1872

       The Consumer Protection Act, 2019

       The Information Technology Act, 2000

       The Sale of Goods Act, 1930

 

Any dispute, claim, or controversy arising out of or in connection with these Terms, including any question regarding its existence, validity, or termination, shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India.

 

Before initiating any legal proceedings, parties agree to attempt to resolve disputes through good-faith negotiation for a period of 30 (thirty) days.

 

 

13. Dispute Resolution & Arbitration

If a dispute is not resolved through negotiation within 30 days, either party may refer the matter to arbitration under the Arbitration and Conciliation Act, 1996 (as amended). The arbitration shall be:

       Conducted by a sole arbitrator mutually appointed by both parties.

       Held in New Delhi, India, in the English language.

       Governed by the Arbitration and Conciliation Act, 1996.

 

Nothing in this clause shall prevent either party from seeking urgent injunctive relief from a competent court.

 

 

14. Consumer Rights Under Indian Law

As an Indian consumer, you have rights protected under the Consumer Protection Act, 2019, including the right to:

       Be protected against unfair trade practices.

       File a complaint with the appropriate Consumer Disputes Redressal Commission.

       Seek redressal for defective goods or deficiency in services.

15. Amendments to Terms

Crazy Toes reserves the right to modify these Terms at any time. Any changes will be posted on this page with the updated effective date. Your continued use of the Platform after such changes constitutes your acceptance of the revised Terms.
